Workers’ Compensation Mediation

Workers’ compensation mediation is an efficient method for resolving difficult workers’ compensation issues. Because mediation is designed to facilitate communication between the parties, it is an excellent way to not only bring the parties together, but also to empower them to resolve their differences by maintaining control over the outcome. The mediator can help the parties clearly identify the issues and develop creative solutions to resolve those issues. During mediation, the parties are separated and discuss the strengths and weaknesses of their cases with the mediator. The mediator helps the parties shape settlement demands and offers, and assists the parties in working toward a mutual agreement. Workers’ compensation mediation can save the parties litigation and discovery costs by working to resolve the issues prior to incurring the costs associated with expert depositions, hearing preparation, and possible appeals. Mediation works.
